GENERAL CONDITIONS OF SALE GITE N ° 3004 FERME DE BONAVIS To pay for your stay, If you live in France: you can pay by check payable to Ms. Carole Delcambre and, if applicable, by credit card. If you live abroad: have a cashier's check drawn up or pay by credit card Article 1: this contract proposed by Mrs. Carole Delcambre is reserved for the exclusive use of the rental of gîte n ° 3004 labeled by Gîtes de France du Nord Article 2: Duration of stay: The client signing this contract, concluded for a fixed period, may not under any circumstances invoke any right to remain in the premises at the end of the stay. Article 3: Liability: The owner who offers services to a client is the sole interlocutor of this client and responds to him for the performance of the obligations arising from these conditions of sale. Ms. Carole Delcambre cannot be held responsible for fortuitous events, cases of force majeure or due to any person outside the organization and conduct of the stay. Article 4: Reservation: The reservation becomes firm when the owner receives a deposit of 25% of the total price of the stay, and a copy of the contract signed by the customer before the deadline indicated. Article 5: Absence of withdrawal: For reservations made by mail, telephone or Internet, the tenant does not benefit from the withdrawal period. And this, in accordance with Article L 121-20-4 of the Consumer Code relating in particular to accommodation services provided on a date or at a specified periodicity. Article 6: Payment of the balance: the customer must pay the owner the balance of the agreed service and remaining due, and this one month before the start of the stay.The customer who has not paid the balance by the agreed date is considered to have canceled his stay. Therefore, the service is again offered for sale and no refund will be made. Article 7: Late registration: In the event of registration less than 30 days before the start of the stay, the full payment will be required upon booking. Article 8: Arrival: The customer must arrive on the specified day and at the times mentioned on this contract. Article 9: Cancellation by the customer: Any cancellation must be notified by registered letter to the owner. - Cancellation more than 30 days before the start of the stay, and before the 21st day included before the start of the stay: 25% of the price of the stay will be retained. - Cancellation between the 20th and 8th day inclusive before the start of the stay. 50% of the price of the stay will be retained. - Cancellation between the 7th and 2nd day inclusive before the start of the stay. 75% of the price of the stay will be retained. - Cancellation the day before or the day of arrival initially provided for in the contract, 100% of the price of the stay will be retained. Article 10: Modification of a substantial element: When, before the scheduled date of the start of the stay, the owner is forced to make a modification to one of the essential elements of the contract, the buyer may, after having been informed by the owner, by registered letter with acknowledgment of receipt: - Or terminate his contract and obtain immediate reimbursement of the sums paid without penalty. - Or accept the modification or substitution of places of stay proposed by the owner. An amendment to the contract specifying the modifications made is then signed by the parties.Any reduction in price is deducted from any sums that may remain owed by the buyer. And if the payment already made by the latter exceeds the price of the modified service, the overpayment will be returned to the tenant before the start of his stay. Article 11: Cancellation by the seller: When before the start of the stay, the owner cancels this stay. It must inform the buyer, by registered letter with acknowledgment of receipt. The buyer will be reimbursed immediately and without penalty for the amounts paid. He will also receive compensation at least equal to the penalty he would have incurred if the cancellation had been made by him on that date. Article 12: Interruption of stay: In case of interruption of stay by the customer, no refund will be made. Article 13: Assignment of the contract by the customer: The purchaser can assign his contract to an assignee who meets the same conditions as him for the stay. In this case, the buyer is required to inform the owner of his decision by registered letter with acknowledgment of receipt no later than 7 days before the start of the stay. The contract assignment must be done at cost price. The assignor and the assignee are jointly and severally liable vis-à-vis the seller, for the payment of the balance of the price as well as any additional costs occasioned by this assignment. Article 14: Insurance: The customer is responsible for all damage caused by him. He is required to be insured by a resort-type insurance contract for these various risks. Article 15: Inventory: An inventory is drawn up jointly and signed by the tenant and the owner on arrival and departure from the gîte. This inventory is the only reference in the event of a dispute concerning the condition of the premises. The tenant is required to enjoy the rented property with due diligence.The state of cleanliness of the cottage on arrival of the tenant, must be noted in the inventory. End-of-stay cleaning is included in the price. Article 16: Reception of animals: When booking, the customer is required to indicate the number of pets that will accompany him. Specific terms of stay for pets may be specified by the owner in internal regulations. The contract may be terminated at the fault of the customer in the event of non-compliance with the conditions of stay. Article 17: Security deposit: On arrival of the client in the rental, a security deposit, the amount of which is indicated on the contract and requested by the owner. After the contradictory establishment of the exit inventory, this deposit is returned, after deduction of the cost of repairing the premises if damage is observed. In the event of early departure, the security deposit is returned by the owner within a period not exceeding one week.
